التصكيك في الأسواق المالية الإسلامية : حالة صكوك الإجارة (Securitization in Islamic Financial Markets: The Case of Ijara Sukuk)

مهد قرار مجمع الفقه الإسلامي المتعلق بالتصكيك في عام 1408هـ لظهور أول نوع من الصكوك في البحرين عام 1421هـ، ثم انتعشت سوق الصكوك بشكل كبير بعد إصدار هيئة المحاسبة والمراجعة للمؤسسات المالية الإسلامية المعايير الشرعية لإصدار هذه الصكوك في عام 1423هـ. وبالنظر لشيوع استخدام صكوك الإجارة، ركز البحث على توصيف هياكل صكوك الإجارة وآلية تصكيكها، ودور الأطراف المختلفة، وأنواع العقود المستخدمة، وقوّم أبرز تطبيقاتها من الناحيتين الشرعية والاقتصادية، وقدم بناء على ذلك مقترحات لتطويرها بما يجعلها أسلم من الناحية الشرعية، وأكفأ من الناحية الاقتصادية. وقد خلص البحث إلى أن تطوير سوق الصكوك يتطلب سن أنظمة وبناء مؤسسات جديدة، أو على الأقل تطوير الأنظمة وتعديل دور المؤسسات القائمة بما يتواءم مع احتياجات إصدار الصكوك وتداولها حسب المعايير الشرعية المعتمدة. The resolution of the Islamic Fiqh Academy on sukuk in 1998 opened the way for the first type of Islamic sukuk in 2001 in Bahrain. The sukuk market witnessed a rapid growth after the issuance of the sukuk Sharia standards by the Accounting and Auditing Organization for Islamic Financial Institutions (AAOIFI) in 2003. Given the widespread use of ijara sukuk, this paper focus on how ijara sukuk are structured, the role of various parties in the structures, and the types of contracts used. The paper reviewed the most applied ijara sukuk structures from both Sharia and Economic point of views, and provided recommendations to design better structures for ijara sukuk. Based on paper conclusions, the development of sukuk market requires introducing new regulation and institutions, or at least reforming the existing ones in line with the needs of sukuk market and compatibility with Sharia criteria
