How is the EU Methane Emissions Regulation implemented in practice? : insights from competent authorities and early enforcement experience

The European Union's Methane Emissions Regulation (MER), effective from 4 August 2024, establishes a regulatory framework for monitoring, reporting and verification of methane emissions and the gradual establishment of an intensity standard for fossil fuel imports by 2030. While the Regulation was proposed by the European Commission and adopted at the EU level, the 27 EU Member States (MSs) are now primarily responsible for its implementation (e.g. adopting national legislation and administrative arrangements) and enforcement (e.g. compliance monitoring). Drawing on a series of semi-structured interviews with the institutions driving this process in MSs - Competent Authorities (CAs) and Responsible Ministries (RMs) - this paper provides insights into early implementation experiences in three major EU fossil energy importing countries: Germany, the Netherlands, and Italy. This research provides three early insights into the implementation of the Regulation from the MSs perspective. First, the implementation of the import requirements has become highly politicised, which may delay implementation but is unlikely to derail it altogether. At least in the early phase, implementation appears to be driven less by formal legal obligations or the CAs technical expertise, and more by administrative readiness and institutional context. Until implementing national legislation is adopted by MSs, the role of CAs remains largely advisory and administrative. Second, while MSs and industry broadly agree on the key implementation challenges, tensions persist between Member States' preference for regulatory flexibility and importers' demand for legal certainty, particularly regarding compliance solutions for complex supply chains and the design of penalty regimes. This tension points to the emergence of an evolving regulatory regime with a central role played by the Network of Competent Authorities (NoCA), which may accept interim and pragmatic approaches in the short term despite these not fully meeting MER requirements, while full compliance remains the longterm objective. Finally, MER implementation requires significant adjustments to existing regulatory practices, particularly with respect to the verification of emissions in third countries and the design of penalty regimes balancing enforcement with security-of-supply considerations, thereby necessitating closer cooperation between CAs and the European Commission.
