Study on matrimonial property regimes and the property of unmarried couples in private international law and internal law
The following report intents to describe the matrimonial property law in Austria. Austrian matrimonial property law to a large extent is settled law. Although very important for marriage this area of law compared to marriage and divorce law is of less interest to legal literature. Only recently and due to European law as well as to partly fundamental changes in society possible changes are discussed. The authors when drafting this report used the most recent literature. Historical aspects are mentioned only where necessary for the overall understanding. Important court decisions as well as further reading are referred to in the footnotes.
