Transparency, the Last Avenger. A Proposal for a Transparency Impact Assessment
The Krees are one of the most scientifically and technologically advanced aliens in the Galaxy, lead by an artificial intelligence being (the Supreme Intelligence). In their long-lasting conflict against the Skrulls, the Krees have set up the Starforce, a team of soldiers that aims to bring peace to the Universe. During a rescue mission on the planet Torfa, a Starforce unit is ambushed and, Vers, one of its most powerful, yet inexperienced, members, accidentally (and literally) falls on Earth. The journey of Vers on our planet will be a cathartic experience: she will discover her true origins (as Carol Denvers, one the first female Airforce's pilots), the real intentions of the Krees (a cruel and imperialistic desire of dominating the Galaxy at all costs), and, above all, she will fully unlock her abilities (an unlimited power absorbed after the exposure to the Tesseract's radiations). The consequences of such a discovery will be particularly heavy for the Kree's forces: when they try to attack the Earth, their entire war fleet is destroyed by the superheroine “Captain Marvel” (aka Carol Denvers).Would the story have been different if the Supreme Intelligence had been transparent about Carol Denvers' past?In the paper, we propose an Earth-based solution for helping the artificial intelligence be compliant with the principle of transparency, enshrined in the General Data Protection Regulation. The principle, already well-known in the consumer protection legislation, establishes that the information to be given to the data subject must be “concise, transparent, intelligible and [in an] easily accessible form, using clear and plain language” (Article 12 General Data Protection Regulation, hereinafter “GDPR”).This constitutes a fundamental obligation for the data controller, especially in light of its accountability. However, the concrete ways to fulfil such an obligation remains largely unclear. We highlight some viable methods to implement in practice the legal rationale pursued by the principle of transparency, presenting a Transparency Impact Assessment based on the lessons learnt from information design
