Lösungsansätze in der internationalen Bankenregulierung und in der IFRS-Rechnungslegung als Antwort auf die Finanzkrise 2008/2009

Die Finanzkrise 2008/2009 hat Schwachstellen in der Bankenregulierung sowie in der internationalen Rechnungslegung zum Vorschein gebracht. Kritik wurde laut, dass die Basler Eigenkapitalvereinbarungen auf Basis der IFRS versagt haben. Die Fair Value-Bewertung habe die Finanzkrise nicht nur verstärkt, sondern ermöglichte deren Ausbreitung auf die Realwirtschaft. In dieser Dissertation wird der Frage nachgegangen, ob der IFRS-Abschluss eine geeignete Grundlage zur Bankenregulierung sei. Weiter geht es um die Gestaltungsmöglichkeiten in der IFRS und in der Basler Eigenkapitalvereinbarungen, welche dazu dienen, dass die Finanzinstitute und letztlich das Finanzsystem stabiler sind. Die Analysen über IFRS als Grundlage zur Bankenregulierung haben ergeben, dass die Fair Value-Bewertung als Überbringerin der Botschaft und nicht Verursacherin der Finanzkrise 2008/2009 bezeichnet werden kann. Eine Expertenumfrage hat gezeigt, dass die Finanzinstitute primär über eine solide Eigenkapitalbasis mit einer zusätzlichen Pufferzone verfügen müssen. Die Puffer können Schwankungen aus der zyklisch wirkenden Eigenkapitalberechnung, der potenziellen Verluste aus übermässigem Kreditwachstum oder der erhöhten Tragweite aus Risiken bei systemrelevanten Banken abfedern. Die Offenlegungspflichten sind um qualitative Informationen zu ergänzen. Letztlich sind Bewertungsdifferenzen zwischen Regulator und Standardsetzer durch standardisierte Prudential Filter zu korrigieren. Die regulatorischen Ansätze sind sehr stark auf das Finanzinstitut und weniger auf das System ausgerichtet. Im risikosensitiven transparenten Netzwerkmodell werden Risiken sowohl top-down als auch bottom-up erfasst. Durch autonom operierende Subsysteme können Korrelationsketten unterbrochen bzw. Teile isoliert liquidiert werden. In Kombination mit den bisherigen Bestrebungen ermöglicht das Modell eine langfristige Stabilisierung der Finanzinstitute und des Finanzsystems.
