A Behavioural Approach to Administrative Corruption Prevention

The paper shows that the ex post criminal approach to corruption should be enriched by ex ante measure, based on two pillars. On one hand, Better Regulation regulation tools, such as open consultation, transparency of the decision-making and an in-depth justification of the final decision and impact assessment (provided that it is enriched by behavioural elements) limits undue bureaucratic discretion and increases accountability. On the other hand, the effectiveness of specific anti-corruption rules (i.e. whistle-blower, staff rotation, transparency in the public sector and transparency of compliance records) depends of the juridical frameworks adopted, which is strictly related to their impact on individual behaviour
