Betriebliche Mitwirkung in der Schweiz – eine Untersuchung der Bestimmungen in Gesamtarbeitsverträgen
Unser Beitrag untersucht in systematischer Weise die Regelungen zur betrieblichen Mitwirkung in Tarifverträgen (Gesamtarbeitsverträgen) in der Schweiz. Er geht von der These aus, dass wegen der späten Kodifizierung der Mitwirkung die formalen und inhaltlichen Kompetenzen von gewählten Arbeitnehmervertretungen in Tarifverträgen häufig über die gesetzlichen Bestimmungen hinausgehen. Wir widmen uns insbesondere Aspekten der „Verbetrieblichung“, d.h. der Verlagerung von Verhandlungskompetenzen von der Branchen- auf die Betriebsebene und zugleich von den Gewerkschaften auf die betrieblichen Arbeitnehmervertretungen. Es finden sich tatsächlich sehr häufig Bestimmungen, die über die gesetzlichen hinausgehen, auch wenn insgesamt das Niveau der Mitwirkungsrechte schweizerischer ArbeitnehmerInnen im europäischen Vergleich niedrig bleibt. Auch ein Einfluss der Gesetzgebung auf die vertraglichen Regelungen kann nachgewiesen werden – diese nahmen seit der Kodifizierung tendenziell zu ‒, während die Bedeutung der „Verbetrieblichung“ in der bisherigen Literatur wahrscheinlich überschätzt wurde.
