Copyright System in the Cloud : Challenges, Opportunities and Prospecting for the Future

In the cloud, the works creation shows a modular, collaborative, and user participating features and the communication and utilization of works shows kinds of features of non-replicated use, multi-tenant use, the actualization of users, and the centralization of communication. The new features in the creation, dissemination and utilization of works in the cloud not only have posed a serious challenge to the copyright system, but also provided an excellent opportunity for the effective enforcement of the copyright system. On the one hand, the increasingly complex of copyright relations makes the use of works facing with increasingly high transaction costs, and the contents of the traditional copyrights are also faced with the danger of failure. On the other hand, the copyright system not only can effectively deal with the crisis brought by the development of the digital network technology, but also can show a better effect in the enforcement of copyright. In the cloud, the copyright law should reshape the contents of copyright to include the new utilization of works, limit copyrights by applying to statutory license to promote the use of works and transform the role of copyright collective management organizations to continue to play its due roles
