Data Protection in India and the EU : Insights in Recent Trends and Issues in the Protection of Personal Data
India’s surge towards a globally preferred destination for investment in IT and product management services often encounters a major hurdle. The obstacle is mostly in the area of protection of personal data, as India lacks a specific legislation for data protection, making the scenario more vulnerable to cyber hacking, theft and related crimes. This article examines the limited protection provided under the IT Act 2000 and IT Rules 2011, and also provides a brief analysis of the landmark judgments in the area of data protection in the country. The article focuses especially on the data protection law in the European Union by analyzing the EU Data Protection Directive to highlight the experience in the EU. Simultaneously, the article highlights the differences between the two regimes. The article also provides for a tabular comparison of the data protection laws in the EU and India, thereby providing readers a vital analysis to comprehend the recent trends in the data protection law in the EU and India
