Der umstrittene Solidaritätszuschlag - Mythen und Fakten
Ende 2009 wurde ein vom Bund der Steuerzahler unterstütztes Verfahren zum Solidaritätszuschlag vom Niedersächsischen Finanzgericht ausgesetzt und dem Bundesverfassungsgericht vorgelegt. Damit wird die Verfassungsmäßigkeit des Solidaritätszuschlags vom Gericht grundsätzlich infrage gestellt. Der Solidaritätszuschlag wird seit dem Jahr 1995 (wieder) als Zuschlag zur Einkommen- und Körperschaftsteuer erhoben, seit dem Jahr 1998 in Höhe von 5,5 %. Gerade diese allmähliche Transformation in eine Dauerabgabe ist es, die berechtigte Zweifel an der Verfassungsmäßigkeit des Solidaritätszuschlags aufkommen lässt. Der aktuelle Vorlagebeschluss hat die Diskussion um den Solidaritätszuschlag neu belebt. Aus diesem Anlass werden im Folgenden die zentralen Argumente, aber auch die häufigen Missverständnisse bezüglich des Solidaritätszuschlags dargestellt.
