Intellectual property rights and national innovation systems - Some lessons from the Mexican experience

[fre] L'idée centrale de cet article est que l'impact du nouveau cadre des Droits de Propriété Intellectuelle (DPI) ne peut se comprendre qu'en prenant en compte les comportements et les réseaux qui caractérisent le système d'innovation mexicain. Dans ce contexte, l'article soutient la thèse que l'analyse de l'expérience des nouveaux arrangements pour les DPIs montre que l'emploi des brevets est peu stimulant pour la création et pour la diffusion locale de technologie, car il ne favorise pas les efforts locaux de recherche et développement ni par les firmes locales ni par le biais des investissements directs des compagnies transnationales. Il ne favorise pas non plus les relations entre les agents du système d'innovation. Enfin, la superposition des incitations qui découlent du nouveau cadre des DPIS, d'un côté, et la libéralisation du commerce de l'autre, renforcent les mécanismes contraires à la diffusion des innovations au sein du système. [eng] The central idea of this paper is that the impact of the new IPR framework can not be understanding outside of the behavioural patterns and linkages that characterize the Mexican innovation system. In a such context, this paper argues that analyzing the experience of the new IPRS frameworks, the use of patents is a weak incentive for the local creation and diffusion of technology ; since, it does not favour the local efforts on R & D - in local firms and thorough FDI of transnational companies and relationships linking the agents of innovation system. Moreover, the superimposition of the set of incentives promoted by the new IPRs framework, on one side, and trade liberalization, on the other, reinforce the adverse mechanisms for the diffusion of innovation within the system.
