Maintaining Impartiality in Mediation

A critical quality in an Alternative Dispute Resolution (ADR) Practitioner, which is important in the event of a conflict, is Impartiality. Impartiality is therefore applicable to the practice of Mediation (an ADR mechanism) and is a core principle of Mediation. Despite their professional training, Mediators tend to draw personal assumptions in certain cases. Nonetheless, they use their training and experience to put aside these assumptions in order to portray complete impartiality. It is an integral part of their role to facilitate discourse and ultimately assist in formulating an agreement between disputing parties. This article provides an overview of the Mediator’s Maintenance of Impartiality throughout the Mediation process
