Overlap between Trade Marks and Geographical Indications in Australia

An ongoing saga concerning the conflict between geographical indications and trade marks in Australia has existed since 1993 in relation to wines. While the implementation of the Australia-US Free Trade Agreement in 2004 has clarified the approach, some grey areas in Australian law currently exist. Legislative changes to the Australian Wine and Brandy Corporation Act 1980 (AWBC Act), while increasing the power and value of a trade mark, has permitted yet more red tape and increased uncertainty in legislative interpretation
