Rechtsprobleme des öffentlichen Auftragswesens im EG-Binnenmarkt
Die für 1992 vorgesehene Vollendung des Binnenmarktes erfaßt auch das öffentliche Auftragswesen. Im Weißbuch der Kommission heißt es dazu, die zuständigen Behörden hätten noch immer die Neigung, inländische Anbieter zu bevorzugen. Angesichts des Ausmaßes dieser nationalen oder regionalen Präferenzen und des Umfanges der öffentlichen Aufträge meint die Kommission, die fortdauernde Aufsplitterung in einzelstaatliche Vergabemärkte ist eine der augenfälligsten Schranken 2 auf dem Wege zur Vollendung eines echten Binnenmarktes . Diese Aussage belegt der Zweite Bericht über die Verwirkli- 3 4 chung der Ziele des Weißbuches mit einigen Zahlen . Danach wird der Gesamtwert der öffentlichen Aufträge in der EG auf ca. 400 Milliarden ECU jährlich geschätzt . Dieser große Markt sei aber praktisch für den realen Wettbewerb auf Gemeinschaftsebene unzugänglich , denn nur 2 vH der Aufträge gingen an Unternehmen aus anderen Mitgliedstaaten. 75 vH fielen an nationale 'Spitzenreiter', auf deren Bedürfnisse die Aufträge regelmäßig zugeschnitten sind .
