The Causes for Banks’ Failure in Romania

This paper analyses the causes for applying the bankruptcy procedure for the banks from the perspective of the Romanian Law and of the fundamental principles regulating the activity of these special entities by underlying the specific features of the banking insolvency that have imposed their differentiation from the traditional corpus of the general insolvency and its regulation in a special manner.The approach of the causes for the banks' failure provided under the Romanian law is carried out by waiving the conception of juridical exclusivism and by applying the principles of banking thinking
