The Individual Responsibility Model of Retirement Plans Today : Conforming ERISA Policy to Reality

Department of Labor administrative policy under ERISA Section 404(c) determines how employers and plan service providers provide retirement investment education and investment advice to participants in self-directed 401(k) plans. This article concludes that current Department of Labor policy is inadequate and proposes specific regulatory changes so that ERISA policy reflects the reality of participant financial illiteracy
