In this paper we propose an answer for the question: Why, sometimes, people don't perceive corruption as a crime? To answer this question we use a neurological and a psychological concept: Mirror Neurons and Theory of Mind

It is shown that the traditional concept “State Capture” does not explain certain observed situations within states protective of the rule of law in process of formation or consolidation. The concept “Co-opted State Reconfiguration” is proposed as a mean for explaining those situations
