A Public Domain Approach to Free and Open Source Software?

This response essay remarks on an article evaluating the potential to use a hypothesized public domain dedication act as an alternative to intellectual property based regimes such as the licensing system that implements Free and Open Source Software (FOSS). The question is whether open innovation communities might enjoy a better future with the dedication act. The essay focuses on this question for FOSS. While acknowledging the potential plausibility of a beneficial dedication act, it presents several considerations that should inform the policy choice for a regime shift or for establishing an alternative regime for FOSS
