Amendment 74 - A Pandora's Box of Property Rights

In November 2018, Colorado voters considered Amendment 74 to the state constitution, which would have radically expanding the definition of regulatory takings in Colorado to include any state or local law or regulation that reduced the fair market value of private property. In this op-ed, published in advance of the election, I laid out some of the potential impacts and unintended consequences that this radical change would bring about, including potential ways that the amendment would backfire on the oil and gas industry, which bankrolled the campaign in favor of the amendment
