Commercial Mediation : An Evolving Frontier of Alternative Dispute Resolution in India

This chapter does not conclude that mediation is appropriate in all matters of commercial dispute, nor does it suggest that mediation supplants other forms of dispute resolution. This chapter does, however, make a case for deepening the understanding of mediation and its application in commercial disputes as a means of offering additional tools from which to draw upon in an increasingly complex world. Mediation has proven to be an extraordinary process of reaching a settlement when conducted by a skilled mediator, assisted by a trained advocate, and participated by informed Users. The authors share a strong belief in the promise of commercial mediation and the increasingly valuable inputs that can be made in employing this approach in India
