How to Deal with Enforcement in Dispute Resolution Systems? Enforcement of Dispute Resolution Outcomes and Mediated Agreements
Enforcement of Dispute Resolution Outcomes in general is the issue of how to let disputants live up to a settlement or a judgment. The settled agreement as the final goal of mediation forms a contract that falls under private law such as contract law, law of obligations and freedom of contract. Since mediation has not been regulated by the law, the final contract has to hold out against the Enforcement of the Mediated Agreement by the parties in dispute. The chapter Enforcement of Dispute Resolution Outcomes highlights the problem as well as litigation judgments, arbitration, arbitral awards, enforcement of arbitral awards, mediated agreements, Online Dispute Resolution and provides with suggestions for what shall be considered in an arbitration clause.The second chapter The Enforcement of the Mediated Agreement is most importantly a collection of what must be covered by the final agreement to successfully close a mediation session. It does not forget to describe the problem and issues as well as giving recommendations on general and specific points. There is also a sub-chapter about current legislation in Europe
