Interpretive problems of Title I of the Labor-Management Reporting and Disclosure Act.
Title I of the Landrum-Griffin Act, the Bill of Rights of Members of Labor Organizations, represents a major step in the evolution of federal regulation of internal union affairs. The courts have been charged with principal responsibility for resolving the numerous interpretational complexities posed by the provisions of this title. These complexities and the judicial solutions rendered to some of them are analyzed in this article. The author concludes that not only is the statute itself inadequate in some respects, but the courts may be exhibiting unnecessary reluctance in interpreting it generously in support of democratic rights of union members.
