Is There Valuable Insight for China in the Polish Experience of Codifying and Re-Codifying Labor Law?

This paper deals with labor law reform in Poland, in particular through codification and re-codification techniques. We start with a short introduction to codification and re-codification initiatives in Poland. However, we decided not to cover very distant history (the first serious attempts to codify Polish labor law go back to 1949 ) and instead to focus on the post-communist, post-1989 era in general, and on the first Codification Commission’s drafts completed in 2006 specifically. We then analyze the pros and cons of codifying/re-codifying labor laws and discuss the obstacles Poland has faced in this respect, especially in the field of collective labor law.
