Protectia dreptului la viata in jurisprudenta CEDO [The protection of the right to life in ECHR practice]

The right to life is a substantial, material right guaranteed to every person and represents the essential condition for the exercise of all fundamental rights and liberties. This principle is included in the constitution of Romania as well. According to art.22 paragraph (1) the right to life, as well as the right to physical and mental integrity of a person are guaranteed. According to art. 2 of the European Convention of Human Rights, the right to life is protected by law. As principle value this text has nothing to do with the problems related to the quality of life problems or to the way in which every person chooses how to live their lives. In order to protect the right to life, the contracting states have both a negative obligation-that of not causing death deliberately-and a positive one-that of taking the necessary measure to protect life.
