The New Israeli Law on Payment Services : Towards a New World of Digital Payments חוק שירותי תשלום, תשע"ט-2019: לקראת עולם חדש של תשלומים דיגיטליים

English Abstract: The article explores the new and innovative Israeli law on digital payment services - the Payment Services Law, 5779–2019. The Law provides a legal structure for the revolution currently taking place in the payment sector in Israel and the move towards digital payments, in an attempt to keep pace with the rapid technological developments and the issues raised by the new world of payments. The Law addresses the relationship between payment service providers and their customers. It prescribes explicit liability arrangements and reflects a strong consumer protection approach. Although the Law was very much inspired by the European Directive on Payment Services (PSD2) that aims to protect consumers, in certain issues it provides even broader protection for the users of the digital payment services, both payers and payees.The article analyzes three major issues included in the Law: The liability of the payment service provider with respect to executing the customer's payment instruction; the payer's ability to cancel a payment order; and unauthorized use of a payment instrument by a third party.תקציר בעברית: המאמר עוסק בחוק שירותי תשלום, תשעט-2019.חוק שירותי תשלום הוא חוק חדשני שנועד לספק מעטפת משפטית למהפכה המתרחשת בימים אלו בעולם התשלומים בישראל - מעבר משימוש באמצעי התשלום המסורתיים לאמצעי תשלום דיגיטליים, תוך ניסיון ללוות בזמן אמת את ההתפתחות הטכנולוגית המהירה בתחום ואת הסוגיות שמעורר עולם התשלומים החדש.החוק מתמקד במערכת היחסים בין נותני שירותי התשלום לבין הלקוחות שלהם, תוך שהוא קובע הסדרי אחריות ברורים ומעניק הגנות חשובות ללקוח המשתמש בשירותי התשלום. החוק שאב השראה מהדירקטיבה האירופית השנייה בנושא שירותי תשלום, המאופיינת בגישה צרכנית אף היא. עם זאת, במספר סוגיות הוא אף מעניק הגנה רחבה יותר למשתמשים באמצעי התשלום הדיגיטליים – משלמים ומוטבים כאחת.המאמר מנתח שלוש סוגיות עיקריות המוסדרות בחוק: אחריותו של נותן שירותי התשלום לביצוע פעולת תשלום בהתאם להוראות הלקוח; ביטול הוראת תשלום על ידי הלקוח; ושימוש לרעה באמצעי תשלום
